TAPDining Terms of Service

1. Who we are and who may subscribe

These Terms govern TAPDining, a service provided by WebWorkBay, California, United States. Contact: sufi@webworkbay.com. TAPDining is a service for restaurants and other authorized business customers. By accepting these Terms, you confirm that you are at least 18 and authorized to bind the subscribing business. A guest viewing a menu does not thereby subscribe or authorize a charge.

2. Your service

Your selected plan and checkout summary describe the services purchased for a restaurant. TAPDining supports restaurant menu management and related table-link, account and reporting functions. Website services are included only in a plan or written agreement that specifies them. Website building and changes are a managed WebWorkBay process; the dashboard does not promise instant website creation or publication. Unreleased features and third-party integrations are not included merely because they appear on a roadmap.

On-site setup is arranged directly with WebWorkBay. Payment does not reserve a particular visit or launch date. We will coordinate access, materials and scheduling with you. Shipped-kit fulfillment is not currently offered. Any additional scope or charge requires disclosure and your agreement before work is charged.

3. Prices and automatic monthly renewal

Current standard prices, in US dollars, are:

  • TAPDining Menu: USD 299 one-time setup plus USD 49 per month. Initial total: USD 348 before any applicable tax disclosed at checkout.
  • TAPDining Menu + Website: USD 799 one-time setup plus USD 99 per month. Initial total: USD 898 before any applicable tax disclosed at checkout.

Each separately purchased restaurant has its own subscription. Your checkout summary controls any expressly agreed offer and shows the initial payment, recurring amount and applicable tax before payment. The setup charge and first monthly charge are due at checkout; monthly billing begins then, not when the on-site visit or public launch occurs. There is no free trial unless expressly offered in writing.

By separately agreeing to recurring billing at checkout, you authorize the displayed monthly subscription charge to your payment method each billing period until canceled. You can review renewal information and invoices through Billing. We will provide notices and obtain additional consent when required by applicable law; fee changes will not be applied retroactively.

Upgrades require your separate approval of the displayed one-time charge, recurring price and effective date. We will not silently enroll you in another plan. Updating payment details or opening the billing portal is not itself an upgrade purchase.

4. Cancellation, refunds and devices

You may stop future renewal through your restaurant's Billing page and customer portal. If you cannot access that option, email sufi@webworkbay.com with the restaurant and account email. Unless a different lawful arrangement is confirmed, service continues through the paid period and ends on the displayed date. Cancellation does not require a phone call or device return first.

Fees are non-refundable and unused periods are not prorated, except where required by law or expressly agreed by WebWorkBay in writing. This does not restrict remedies for unauthorized or erroneous charges or other rights that cannot lawfully be excluded. See the separate Refund, Cancellation & Device Return Policy for full details.

WebWorkBay-supplied loaned devices remain WebWorkBay property unless a separate written agreement expressly transfers ownership. A setup payment alone does not purchase the devices. Return loaned devices within 14 days after service ends. You pay return shipping unless WebWorkBay arranges pickup; normal wear is accepted. Contact sufi@webworkbay.com for return instructions. No automatic damage, replacement or non-return charge applies without separately disclosed and agreed pricing. A device dispute does not restart or extend canceled monthly billing.

5. Accounts and restaurant content

Keep account access secure, use authorized team accounts and notify us promptly about suspected misuse. You are responsible for your authorized users and for reviewing menu prices, descriptions, dietary and allergen statements, availability, photos and links before publishing. AI-assisted menu imports can make mistakes and require human review. TAPDining is not food-safety or allergen advice.

You retain ownership of content you supply. You grant WebWorkBay the limited rights to host, process, format, display and transmit that content as needed to provide and support your service. You confirm you have the necessary rights and permissions. Do not submit unlawful, infringing, deceptive or malicious material, attempt unauthorized access, interfere with other restaurants, or misuse guest information. Publicly published menus and links can be viewed and shared by others.

6. Availability, third parties and support

We use reasonable care to operate TAPDining, but do not promise uninterrupted service, compatibility with every device, particular sales results or an uptime guarantee unless separately agreed. Internet access, guest devices, payment processors and third-party services can affect availability. Keep an alternative way to provide menus during an outage. Contact sufi@webworkbay.com for support; no fixed response-time commitment applies unless agreed in writing.

We may reasonably restrict access to protect security, address unlawful activity or respond to nonpayment, with notice and an opportunity to resolve the issue where practical and lawful. We will not use suspension to evade a cancellation or a legally required remedy.

7. Privacy and ending service

Our TAPDining Privacy Policy explains how we handle information. You are responsible for lawful collection and use of information you submit about others. Before service ends, contact us if you need help retrieving restaurant content. Access and hosted functionality may end with your service. We retain or delete information according to the Privacy Policy and applicable law; cancellation does not necessarily erase accounting or security records immediately.

8. Responsibility and disputes

To the extent permitted by law, neither party is responsible to the other for indirect or consequential losses arising from these services. WebWorkBay's total liability for claims arising from TAPDining is limited to the fees you paid to WebWorkBay for TAPDining during the 12 months before the event giving rise to the claim. These limitations do not apply to fraud, willful misconduct, gross negligence, statutory remedies, or liability that applicable law does not permit to be limited. Nothing in these Terms excludes non-waivable warranties or rights.

California law governs these Terms, without overriding mandatory protections that apply in another jurisdiction. Contact sufi@webworkbay.com first so we can try to resolve an issue. These Terms do not impose mandatory arbitration or waive rights that cannot legally be waived.

9. Changes and contact

We may update these Terms prospectively. We will identify the effective date and provide notice of material changes and obtain consent where required. Changes will not retroactively remove accrued rights. If a provision is unenforceable, the remaining provisions continue to the extent lawful. Contact WebWorkBay at sufi@webworkbay.com.
